Bungee Jumping

Zander  wants to build a bungee jumping tower in his back yard. He wants the ride to last at least 5 seconds. Town code says he may not build a tower more than 50 meters. Gabe said the tower would need to be more than 50 meters to get a five second ride. Dom disagrees he states that the rate of fall is just 9.8m/s 2 due to gravity,  therefore the tower would only need to be 49 meters tall. Who is correct Dom or Gabe? Would Zander be allowed to build his five second bungee jump?
